HVAC Visalia is a referral and connection service. We are not an HVAC contractor, do not perform the work, and are not a party to any agreement between you and an independent provider.
1. Acceptance of these Terms
These Terms & Conditions (“Terms”) govern your access to and use of hvacvisalia.com and the related referral service (collectively, the “Service”) provided by HVAC Visalia (“HVAC Visalia,” “we,” “us,” or “our”). By accessing the Service or submitting a request, you agree to these Terms and our Privacy Policy.
If you do not agree, do not use the Service. You must be at least 18 years old and legally able to enter into a contract to submit a request.
2. What the Service does
The Service allows users to describe an HVAC need and request contact from one or more independent HVAC providers that may serve the requested location. We may review, categorize, route, and transmit requests to participating providers.
We do not guarantee that a provider will accept or respond to a request, that service will be available within a particular time, that any estimate will meet your budget, or that multiple quotes will be provided.
3. Your request and responsibilities
- Provide accurate, current, and complete information.
- Submit a request only for yourself or with authorization from the person responsible for the property.
- Use the Service for legitimate HVAC-related needs and not for spam, competitive intelligence, harassment, or unlawful purposes.
- Independently review any provider, estimate, scope of work, contract, warranty, permit, and payment term before proceeding.
The Service is not an emergency-response service. For immediate threats involving fire, gas, carbon monoxide, electrical hazards, or personal safety, leave the affected area when appropriate and contact emergency services or the relevant utility.
4. Calls, texts, and emails
When you submit a request and provide contact information, you ask us to help connect you with HVAC providers. Subject to the consent language presented with the form and applicable law, HVAC Visalia and participating independent providers may contact you about the request by telephone, text message, or email, including through automated technology. Message and data rates may apply.
Consent to receive marketing communications is not a condition of purchasing goods or services. You may withdraw consent or opt out as described in our Privacy Policy.
5. Independent HVAC providers
Providers are independent businesses or professionals. They are not our employees, agents, joint venturers, franchisees, or representatives. A provider alone is responsible for its licensing, insurance, personnel, permits, diagnosis, estimates, contracts, payments, warranties, safety practices, work, omissions, and results.
Any hiring decision and any contract for HVAC work is solely between you and the provider. HVAC Visalia is not a party to that contract and does not receive or hold customer payments for HVAC work unless expressly disclosed in writing.
Before hiring anyone, you should independently verify current licensing, insurance, references, complaint history, permits, and any other credential important to you. A referral or match is not an endorsement, certification, warranty, or guarantee.
6. Referral model
Submitting a consumer request is currently free. We may receive a fee or other compensation from participating providers for referrals, leads, advertising, or related services. This business relationship does not increase or guarantee provider availability, and providers determine their own customer pricing.
7. Acceptable use and intellectual property
You may use the Service only for personal or internal business purposes consistent with these Terms. You may not interfere with the Service, probe its security, scrape or harvest information, introduce malicious code, impersonate another person, submit false requests, reverse engineer protected portions of the Service, or use our content or branding in a misleading way.
The Service, including its design, text, graphics, branding, software, and organization, is owned by or licensed to HVAC Visalia and is protected by applicable intellectual property laws.
8. Third-party services and links
The Service may link to or interact with provider websites, communication platforms, maps, analytics, and other third-party services. We do not control and are not responsible for third-party content, availability, security, terms, or privacy practices.
9. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” HVAC Visalia disclaims all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and results.
We do not warrant the identity, qualifications, licensing, insurance, availability, pricing, conduct, workmanship, safety, or suitability of any provider. Nothing in these Terms excludes a warranty or right that cannot be excluded under applicable law.
10. Limitation of liability
To the fullest extent permitted by law, HVAC Visalia and its owners, affiliates, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, or opportunities; property damage; personal injury; or damages arising from a provider’s acts, omissions, work, estimate, contract, or communications.
To the fullest extent permitted by law, our aggregate liability for claims arising from or relating to the Service will not exceed the greater of the amount you paid directly to HVAC Visalia for the Service during the six months before the event giving rise to the claim or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
11. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless HVAC Visalia and its owners, affiliates, personnel, and service providers from claims, damages, liabilities, costs, and expenses arising from your misuse of the Service, violation of these Terms, violation of another person’s rights, or false or unauthorized information you submit.
12. General terms
We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms by posting a revised version with a new effective date.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Subject to any non-waivable right, claims relating to these Terms or the Service must be brought in the state or federal courts located in or serving Tulare County, California.
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. These Terms and the Privacy Policy form the entire agreement between you and us regarding the Service.
